Customer Terms of Service

Please read the customer terms of service carefully.

Our Prospect Accel Customer Terms of Service are the legal agreements that are used by our customers.

These encompass the General Terms that relate to how you can use our products and services. The Data Processing Agreement (DPA) outlines how we handle your personal data and includes the EU Standard Contractual Clauses. Acceptable Usage Policy details the guidelines for using our products and services, outlining allowed and prohibited actions.

We occasionally make changes to these terms. If you have an active Prospect Accel subscription, we will let you know when we update the terms via email notification (if you have subscribed to receive email updates).

Definition

The term "Agreement" or "Customer Terms of Service" refers to these General Terms as well as any items mentioned or linked to within. To make it easier for you to use our products and services and maintain your Prospect Accel account, we've included links to knowledge base articles throughout this Agreement. Please note that these links are for your reference only and are not part of this Agreement.

"Contact" refers to a single person whose Contact Information you have kept in the Subscription Service and who is not a User. The term "Contact Information" refers to the name, phone number, email address, online username(s), and other details that users of your landing pages on the Subscription Service provide. All information you give or gather through the Subscription Service is referred to as "Customer Data". Prospect Accel Content is not included in Customer Data.

"Free Services" refers to the Subscription Service and any other features or products that we provide to you for free or as a trial. The amount you pay for the subscription service is referred to as the "Subscription Fee".

"Users" means your employees, agents, consultants, contractors, or agents who are authorized to use the Subscription Service on your behalf and who have unique usernames and passwords for the Subscription Service.

Users must be at least 18 years of age to use the Subscription Service.

You may not use the Subscription Service if obtaining or using the Subscription Service is prohibited by the law of the country in which you reside.

If you pay by credit card, you authorize us to charge your authorized payment method for all payments due during the subscription period. In addition, you authorize us to use a third party to process payments and agree to disclose your payment information to such third party.

You are responsible for maintaining accurate and current business details such as your business name, address, and primary contact person. Additionally, you must ensure that your authorized payment method and billing information are up to date for both current and recurring payments, including tax information.

Termination:

The initial term of your subscription will be outlined in your order. Unless stated otherwise, your subscription will automatically be renewed for either the same duration as your previous term or one year, whichever is shorter.

Early cancellation:

You may cancel your subscription early if you wish, provided that we do not refund prepaid fees or unused subscription fees and that you promptly pay all unpaid fees due at the end of the current period.

Suspension:

According to Suspension for Prohibited Acts, we may suspend the user service without notice.

Engaging Prospect Accel's email delivery services in a manner that leads to a high number of bounces, spam complaints via the feedback loop, direct spam complaints, or requests for removal from mailing lists is prohibited. Additionally, repeatedly sending material that infringes or is alleged to infringe on the copyright or trademark rights of any individual or entity is not allowed.

We'll notify you if any payment is overdue. If the full amount isn't paid, we reserve the right to suspend your access to some or all of the Subscription Services ten (10) days after notifying you. However, if you're disputing the charges in good faith and actively cooperating to resolve the dispute, we won't suspend the Subscription Service. In the event of suspension due to non-payment, a reactivation fee may be applied to reinstate the Subscription Service.
